Digitalizarea urbanismului începe în mediul BIM.

Ordinul 904/2023 introduce obligativitatea predării documentațiilor de urbanism în format GeoPackage (GPKG), un format nativ GIS. În același timp, majoritatea birourilor de arhitectură și urbanism din România lucrează preponderent în Archicad, într-un flux BIM complet diferit de cel GIS.

GeoPackage Manager este Add-on-ul dezvoltat de CONSOFT pentru a integra funcțiile GIS direct în Archicad, fără a obliga utilizatorii să migreze către aplicații specializate GIS precum QGIS. Add-on-ul poate importa, edita, valida și exporta fișiere GeoPackage, respectând schema oficială a MDLPA și regulile de validare ale platformei naționale.

End-User License Agreement (EULA) for GeoPackage Manager Add-On

This End-User License Agreement (“Agreement”) is a legal contract between you (“Licensee” or “you”) and CONSOFT CONSULTING SRL (“Publisher”). By installing or using the GeoPackage Manager Add-On for Archicad 28+ (“Software”), you agree to be bound by the terms below.

1. Definitions

“Software” means the GeoPackage Manager Add-On for Archicad 28+, including all updates, patches, documentation, images, and associated materials provided by Publisher or Developer.

“License” means the rights granted by Publisher to you under Section 2 of this Agreement.

“Non-Disclosure Materials” means those portions of the Software and related technical information marked or otherwise designated as subject to nondisclosure restrictions.

“Data Collection” means the automated gathering of non-personal run-time usage data and hardware information as described in Section 6.

“User ID” means the unique identifier assigned to the Licensee for license activation and management.

“Device Limit” means the maximum number of hardware‐fingerprinted devices permitted under the Licensee’s subscription.

“Publisher” means CONSOFT CONSULTING SRL with CUI RO16182863.

“Developers” means Inter Soft SRL and Novelkis Kft., collectively responsible for software development.

2. License Grant

You are granted a non-exclusive, non-transferable, revocable license to:

• Install and activate the Software on hardware‐fingerprinted devices up to the Device Limit associated with your User ID;
• Use the Software solely to extend the functionality of your licensed copy of Archicad 28+ in accordance with its terms and this Agreement.

License activation is bound to both your User ID and the hardware fingerprint of each device. Device deactivation or reassignment is not automated and may only be performed upon written request sent to addons@consoft.consulting. Publisher may request evidence of legitimate need before processing such requests.

This License does not permit sub-licensing or distribution of the Software in binary or source form.

3. Restrictions

You may not, directly or indirectly:

• Modify, translate, adapt, or otherwise create derivative works of the Software;
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive source code;
• Rent, lease, lend, sell, redistribute, or sublicense the Software;
• Remove, alter, or obscure any proprietary notices or labels on the Software;
• Attempting to bypass, spoof, or alter hardware fingerprinting or activation mechanisms is strictly prohibited.

4. Intellectual Property Ownership

All title, ownership rights, and intellectual property rights in and to the Software, including any copies, are retained by Publisher and Developer. The Software is protected by copyright laws and international treaties.

5. Privacy and Data Collection

Before installation, you acknowledge and accept that the Software will collect the following non-personal information:

• Run-time usage metrics (e.g., feature invocation counts, execution time);
• Hardware details (e.g., CPU model, available memory, graphics card type);
• Benchmark data related to Software performance.

Collected data is used solely to improve Software stability, performance, and feature development. No personally identifiable information is captured, stored, or transmitted.

License usage patterns, activation attempts, and hardware fingerprint information may also be reviewed for fraud prevention, misuse detection, and enforcement of licensing limits. Fraudulent or suspicious activity may result in suspension or termination of the License without refund.

6. Subscription, Support, and Updates

Support services, maintenance, updates, bug fixes, and feature upgrades are provided exclusively during an active subscription period. Once a subscription expires, access to support, updates, and any license‐related services (including device deactivation) will be suspended until renewal.

7. Disclaimer of Warranties

The Software is provided “as is,” with all faults and without warranty of any kind. Publisher and Developer disclaim all warranties, whether express, implied, statutory, or otherwise, including but not limited to:

• Merchantability or fitness for a particular purpose;
• Non-infringement of third-party rights;
• Accuracy, reliability, or completeness of any information or data.

8. Limitation of Liability

To the maximum extent permitted by law, in no event shall Publisher or Developer be liable for any:

• Indirect, incidental, special, consequential, or punitive damages;
• Loss of profits, revenue, data, or business interruption;
• Claims by any third party.

The total cumulative liability of Publisher and Developer under this Agreement shall not exceed the license fees you paid for the Software, or, if no fee was paid, fifty US dollars (USD 50).

9. Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any term. Upon termination you must:

• Cease all use of the Software;
• Delete or destroy all copies in your possession.

Sections 4, 5, 7, 8, 9, and 10 will survive termination.

10. Governing Law and Dispute Resolution

This Agreement is governed by the laws of Romania without regard to conflict-of-law principles. Any dispute arising out of or relating to this Agreement shall be finally settled by the competent courts at the Beneficiary’s headquarters, under the rules of the International Chamber of Commerce. The arbitration shall be conducted in Romanian.

11. Miscellaneous

• Entire Agreement: This Agreement constitutes the entire understanding between you and Publisher regarding the Software.
• Company‐Wide Use: Company‐wide installation under a single User ID is permitted, provided that the number of activated devices does not exceed the Device Limit defined by the purchased subscription tier.
• Amendments: Publisher may update this Agreement at any time by posting a revised version online. Your continued use constitutes acceptance.
• Severability: If any provision is held invalid, the remainder shall remain in full force.
• No Waiver: Failure to enforce any provision shall not constitute a waiver.

By installing or using GeoPackage Manager, you confirm that you have read, understand, and agree to be bound by this Agreement.
